Terms of Service
Draft — not published. Last reviewed against the code on 2 September 2026.
These terms are an agreement between you and AI Machine Solutions LLC ("we", "us") covering your use of Banger Studio. By using the service you accept them.
1. Who can use it
You must be at least 13 years old. If you are under the age of majority where you live, you may use the service only with a parent or guardian's permission. You are responsible for everything done through your account.
2. What the service does
Banger Studio generates original instrumental and vocal music from the parameters you choose. A generation produces audio, a MIDI arrangement, cover art, optional sung vocals and an optional video.
Generation is not instantaneous and is not guaranteed. Renders can fail, queue, or produce something you do not like. That is the nature of the thing, and it is why the free tier exists.
3. Credits, tiers and payment
Some features cost credits. Credits are bought through Stripe's hosted checkout; we never see your card details.
- Credits have no cash value and are not redeemable for money.
- Credits do not expire while your account is open.
- A failed render does not consume a credit. If one does, tell us and we will restore it.
- Prices can change. A change never affects credits you have already bought.
Refunds. We will refund an unused credit purchase within 14 days on request. Credits already spent on a completed render are not refundable, because the cost of producing them has already been incurred. If the service fails you — a render that never completes, a charge for something you did not receive — email us and we will make it right, inside or outside that window.
4. What you own
You own what you make. Songs, lyrics, cover art and video generated for you through your account are yours, including for commercial use: release them, sell them, sync them, distribute them. Each track is generated once, for one account, and we license it to you exclusively — we do not sell or license the same recording to anyone else.
Two things bound that:
- We cannot grant more than we hold. Generation runs through third-party models (currently ElevenLabs, OpenAI and Runway) whose own terms apply to their outputs. Where their terms are narrower than this section, theirs govern.
- AI-generated works may not be copyrightable in some jurisdictions. We make no promise that you can register or exclusively enforce a generated work.
The licence you give us. To run the service we need permission to store your songs, serve them back to you, and show them on the public surfaces described in section 5. That licence is non-exclusive, worldwide, royalty-free, and lasts only while your content is on the service. It exists so the product can work. We will not license your music to anyone else, and we do not use it to train AI models.
5. Your songs are visible to other people
A finished song with vocals is public unless you mark it private. By default it appears on the Floor — the in-app community radio — where any signed-in user can play it, and it gets a share page at /s/<id> that anyone with the link can open without signing in. That page shows the title, your artist name, the cover art, a player, and any profile links you added.
You can keep a song private, either before generating it (the checkbox next to Generate) or afterwards (the Private/Public control in the song's drawer). A private song is off the Floor and its share page stops resolving, which means a link you already gave someone will no longer open.
Your email address is never shown. Only the display name and artist name you choose.
Deleting a song removes it from both surfaces.
Publishing to SoundCloud is a separate, deliberate action on a specific track.
6. What you may not do
- Generate content that is illegal, that harasses or defames someone, that sexualises minors, or that incites violence.
- Impersonate a real artist, or use the service to imitate a specific person's voice or likeness without their permission.
- Submit lyrics or prompts you do not have the right to submit.
- Resell, sublicense or rebrand the service itself, or present its output as another service's.
- Evade the free-tier limits, share an account, script the interface, or otherwise take more capacity than the service offers you.
- Attack, probe, overload or reverse-engineer the service or its providers.
We can remove content and suspend accounts that breach this section. Where it is practical and lawful, we will tell you why first.
7. Availability
The service is provided as it is. We do not promise any level of uptime, any particular generation speed, or that any specific feature will continue to exist. We may change, suspend or discontinue any part of it. If we discontinue the service entirely, we will give reasonable notice and a way to download what you have made.
8. Third-party services
Signing in uses Clerk. Payments use Stripe. Generation uses ElevenLabs, OpenAI and Runway. Storage uses Cloudflare. Optional publishing uses SoundCloud. Their terms apply to their parts, and we are not responsible for what they do.
9. Liability
To the fullest extent the law allows: the service is provided without warranties of any kind, and our total liability to you for any claim is limited to what you paid us in the 12 months before the claim. We are not liable for lost profits, lost data, or indirect or consequential loss.
Nothing here limits liability that cannot lawfully be limited.
10. Ending it
You can stop using the service at any time and ask us to delete your account. We can suspend or close an account that breaches these terms. Sections 4, 9 and 11 survive the end of this agreement.
11. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules.
12. Changes
We may update these terms. Material changes will be announced in the app before they take effect; continuing to use the service afterwards means you accept them.
